Terms & Conditions

1. 1. Agreement to terms: By creating an account and using My Real Estate Listing to generate brochures, you agree to these Terms & Conditions.
2. 2. Nature of the product: Brochure texts are generated by artificial intelligence and can contain errors, omissions or invented details. You are responsible for checking every brochure before you publish it or hand it to a client — in particular prices, measurements, and any information your local law requires in a property advertisement, such as energy performance data. We make no warranties or guarantees regarding effectiveness or return on investment.
3. 3. Usage rights: You are free to use the generated content however you wish, including unlimited modifications.
4. 4. Your content and your account: You keep every right in the photos and details you upload, and you confirm that you are entitled to use them — do not upload images you did not take or license, and do not enter personal data of third parties you are not allowed to use. If a third party raises claims against us because content you uploaded infringes their rights, you will compensate us for the resulting damage and reasonable costs of defence, unless you are not responsible for the infringement. You are responsible for what happens under your account — keep your sign-in credentials to yourself.
5. 5. Free use: The service is free. There is nothing to buy and no card to enter. Each account receives 3 credits at the start of every calendar month; one credit produces one finished brochure, previews cost nothing, and unused credits do not carry over. The credits exist to keep the processing cost of the service predictable, not as a price. We may change the number of credits, or stop offering the service, at any time. We will never start charging an account that exists today without asking you first and getting your agreement.
6. 6. Availability and your files: The service is provided as it is, without any promise of availability. We may change features, take the service offline for maintenance, or discontinue it. Keep your own copy of anything that matters: download the finished PDFs rather than relying on this account as your archive. We may delete accounts that have been inactive for a long time, and will give you notice by email before we do.
7. 7. Acceptable use: Use the service for genuine property listings. Do not use it to produce misleading advertisements, to generate content about people without their agreement, to attempt to overload or circumvent the service's limits, or for anything unlawful.
8. 8. Right to refuse service: We may refuse or end service where these terms are broken or where the service is being used in a way that harms it or its users.
9. 9. Limitation of liability: We are liable without limitation for intent and gross negligence, for injury to life, body or health, and wherever the law allows no limitation. For slight negligence we are liable only where an obligation is breached whose fulfilment makes proper performance possible in the first place and on whose observance you may rely, and in that case only for the damage typically foreseeable for this kind of contract. Because the service is provided free of charge, our liability is further limited to the extent the law provides for gratuitous services.
10. 10. Governing law: German law applies. If you are a consumer, this does not deprive you of the protection of the mandatory provisions of the law of the country in which you have your habitual residence.
11. 11. Changes to these terms: We may update these terms. If a change materially affects you, we will tell you by email before it takes effect and you may stop using the service.
12. 12. Miscellaneous: Neither party is liable for failure to perform caused by circumstances beyond its reasonable control. This agreement does not establish a partnership, and no third-party rights are conferred unless explicitly stated. If a provision turns out to be invalid, the rest stays in force.

Privacy Statement

My Real Estate Listing is a digital service that uses artificial intelligence to produce real estate brochures. Here is what we collect, why, and who else touches it.

• Who is responsible: Julian Knappe, Neugartenstraße 9, 83209 Prien am Chiemsee, Germany — reachable at info@myrealestatelisting.app. Full details are in the imprint.
• What we collect: Account data you give us: your name, your email address, and your password (stored only as a cryptographic hash by our sign-in provider — we never see it). Listing data you enter: property details, the photos you upload, and the contact details you want printed on the brochure. Technical data that arises automatically: IP address, browser type, and timestamps in server logs.
• Why, and on what legal basis: To provide the service and your account — Art. 6 (1)(b) GDPR, performance of a contract. To keep the service running, secure and free of abuse, including server logs and the monthly usage limits — Art. 6 (1)(f), our legitimate interest. To send you the newsletter, if and only if you switched it on — Art. 6 (1)(a), your consent, which you can withdraw at any time in Settings. To process payments, for accounts that hold a subscription — Art. 6 (1)(b).
• Who else processes it: We use the service providers listed in the table below, each under a data processing agreement. Some of them process data in the United States; those transfers rest on the European Commission's standard contractual clauses and, where applicable, the EU–US Data Privacy Framework. No data is sold, and nothing is passed on for advertising.
• How long we keep it: Your account data and your listings stay until you delete them or ask us to delete your account. Server logs are kept for a short period for security purposes. Where the law requires records to be retained, we retain them for that period and no longer.
• Automated decisions: The brochure text is written by an AI model, but no automated decision is made about you: nothing in this service profiles you or decides anything with legal effect for you.
• Your rights: You can ask us for a copy of your data, for corrections, for deletion, for a restriction on processing, and for your data in a portable format. You can object to processing based on legitimate interest. You can withdraw consent at any time with effect for the future. And you can complain to a data protection supervisory authority — in Germany, the authority of the federal state in which you live.
• Cookies and local storage: Only what the product needs: staying signed in, remembering your theme, and — for subscribers — the cookies Stripe sets on its own checkout domain. There is no analytics, no advertising and no cross-site tracking, which is why you are not asked for consent to any. See “Cookies” in the footer.
• Changes: We may update this statement. The current version always lives on this page.
